INSTITUTIONAL FOUNDATIONS FOR BALANCED LAND USE


The authors present a vision for solving the problem of achieving a balanced level of utilization of land for forestry purposes in the system of institutional links of socio-economic development, taking into account the European integration processes. There are many fundamental laws in Ukraine that regulate forest land use, but the inconsistency and lack of effectiveness of certain legislative provisions do not contribute to achieving a balanced use of forest land. The ways of improving the functioning of the institutional regulator are proposed, in particular, concrete proposals are made for the development and amending of the Forest, Land and Tax Codes of Ukraine. It is necessary to legislate that the object of forestry work is land for forestry purposes. Also today there is a discrepancy between the norms of individual laws of Ukraine with the Forest and Land Codes. In particular, the Laws of Ukraine “On Land Protection”, “On State Control over Land Use and Protection”, “On Environmental Impact Assessment” should be supplemented with the rules on legal and organizational bases of assessment of the impact of forestry activity on the state of forest land. This will promote the introduction of a system of legal, organizational, economic, technological and other measures aimed at protecting land not for the presence of biocenosis on the soil surface, but for the intended purpose. It is necessary to develop and adopt the Law on Forests in Ukraine and the Order of Use of Forest Land, which should be based on the rational and proven principles of the integrated environmental management of the Polish Forest Law (Ustawa). In the end, it will help to solve the key tasks of the functioning of the financial and economic mechanism to achieve a balanced level of use of forest land.
