ECONOMIC AND LEGAL ASPECTS OF REFORMING HOUSING AND UTILITIES SERVICES IN UKRAINIAN CITIES


The problems of development of housing and utilities services sector of Ukrainian cities are investigated and proposals for its reform based on the use of economic and legal approaches are developed. The economic approaches are related to the development of the economy of the city's housing and utilities services sector taking into account market conditions. The legal approaches include the legal provision of regulation of relations in the process of economic development of the city's housing and utilities services sector. The technical-technological, socio-economic, institutional-legal, organizational-spatial features of the housing and utilities services sector are characterized, its status in Ukrainian cities is evaluated, problems that hinder its development and the solutions of which require reforms are identified. It is determined that the reform of the housing and utilities services sector of Ukrainian cities is aimed at improving financial security, strengthening institutional coherence, transparency of tariff formation, social responsibility and innovativeness of activity. This implies the continuation of decentralization of power and extension of powers of local self-government bodies, demonopolization and deepening of competition in the housing and utilities services market, innovative development of municipal enterprises, modernization of utilities infrastructure, provision of information transparency and involvement of the public in decision-making. The foreign experience of reforming the housing and utilities services sector and the possibilities of its adaptation for Ukrainian cities is analyzed. In particular, the models of organization of the market of housing and utilities services, formation of market institutions (including interaction of associations of co-owners of apartment buildings and managing companies), mechanisms of tariff formation and tariff regulation, use of participatory budgeting and spatial inter-municipal cooperation. In order to solve specific problems of reforming the sector of housing and utilities services of the city, proposals on the use of economic and legal instruments are developed, which include: an institutional-investment approach to the consolidation of efforts of participants of the housing and utilities services market; formation of conditions for observance of the principle “quantity – quality – cost of services” in accordance with the implementation of the Law of Ukraine “On Housing and Communal Services”; ways to increase publicity and transparency of the housing and utilities services sector through the use of local initiatives, public-private partnerships, and public consultation with the public.
